USE OF THE PLATFORM

Welcome to Radium Care its tools and applications is an online service that is run and managed by Radium Care Private Limited (Radium Care or we or us). The combination of both the Website, tools, and applications are known as Platforms. You are deemed to have agreed to the terms and conditions of the agreement below and any changes that might be made here and then by the use of Radium Care Platforms, services or products, at a time one or another, at any time up to the time you access/use Radium Care Platforms (User Agreement) /“T&C.

They are Terms of Use, and they govern the way you use and conduct yourself on our platforms, whether you are using them on a computer or on a mobile handset (an iOS or Android application). You accept to review these Terms and Conditions as often as possible because we reserve the right to change, add, to remove or to make amendments in any part of the same Terms and Conditions at any moment and with no prior notice to you. Any further usage of the Platforms after such revisions will mean that you do not disagree with the T&C revisions and intend to follow it. This is the reason why we want you to read these T&C whenever you access and place your order. User herein shall refer to the persons who browse, access, place orders of products and/or who utilize the services (Users).

Regardless of whether you read the Policies, by accessing or using the Platform, you rank to agree to the terms of use and policies of the Policies. Using, searching or otherwise using the platforms amounts to a conditionless acceptance of all the terms and conditions of this agreement and thus please take your time to go through this agreement and then proceed.

ELIGIBILITY TO USE

The Platforms can only be used by individuals who can enter legally binding contracts in accordance with the applicable laws. The Platform users may not be incompetent to contract as described in the Indian Contract Act, 1872 that encompasses undischarged insolvents and others. We may, at our own will, terminate your membership and refuse you entry into the Platforms. The individuals who have been suspended or terminated of membership by us due to any reason will not be permitted to use the Platforms.

You attest that you are empowered to bind the business entity to this User Agreement on your behalf in case you are one. We also do not guarantee that any of the products or services mentioned in the materials on the Platforms can be found beyond India. Users who prefer to use these Platforms and its tools outside India themselves bear the duty of complying with local laws to the extent that they have local laws which are applicable. We ship the goods within India and we will not be liable to any claims concerning any goods ordered outside India. All our products will be shipped to states whose import policies are open, and we shall not be responsible for any order made on products originating in a state with import restrictions.

You have to be at least eighteen years old in order to buy our products and/or avail our services. It involves, though is not confined to, utilizing one of our platforms, our site, mobile applications, and social media, chatting with one of our professionals, subscribing to our newsletters, and providing personal information, etc.

ACCURACY OF CONTENT AND INVITATION TO OFFER

By exercising due diligence and care, we have given appropriate information and data. We have made sensible precautions to ensure that nothing has been wrongly stated or the prices quoted are correct when we were preparing to publish information to the Platforms. This is more so when it concerns the prices of the products. Every price form is inclusive of all taxes. The products can be packaged differently than what is displayed on the Platforms. The weights, dimensions, and capacities are only approximate. We have done our best to show the colors of our products that we present on the Platforms as much as possible. Nonetheless, since the colors that you will actually see will be determined by your monitor/phone screen, we cannot assure that whatever color your monitor/phone screen shows will be a true representation of the color of the product on delivery. We only provide the content which is present on the Platforms about our products/services as furnished by us. In case you want to use any other platform or platforms such as the social media sites, we will not hold you responsible for the information unless we have verified it to you in advance.

Every product/service and information provided on the Platforms qualify as an invitation to offer. Your purchase order is an offer which is subject to the terms and limitations as per this User Agreement. We may at our own discretion either accept or decline your offer in part or entirely. We will respectively record your order as accepted as soon as the ordered goods or products are shipped. There might be a chance that not all the items are shipped immediately you had ordered them. In case such a situation appears, what part of the order so shipped we already have will be regarded as accepted by us, and the rest will be subject to the possibility of its being accepted or rejected. Radium Care is not going to accept your offer in any sense before the product(s) in which you have ordered are actually shipped. Should you have submitted your contacts to us we will either call you over the phone or send you an email as soon as we can to ensure that we have received your order. We will also make a follow up to you in case of any need to ensure that the order has been sent and, therefore, received.

GENERAL TERMS OF USE

By using these, the users will be bound by the following General Terms of Use:

The users are, therefore, entitled to use the Platforms in a legal manner and towards the purposes as indicated in the policies of Radium Care. Any breach of the policy will result in a serious legal prosecution on the User according to terms of the policies and the laws.

Radium Care aims at offering optimal prices on the products and services to Users purchasing or buying them via the Platforms. Radium Care has no obligation to provide any notice or any consequential liability of giving change to prices and availability.

The displayed prices and offers on each product under a promotion will be on limited stocks in the selected categories and during the days involved in the promotion.

Radium Care is at its own authority to alter, renew, revise or cancel the offers on products without giving any prior notice to the Users. The revisions, as the case may be, will be revised in the Platforms in such events.

Where applicable to Cashback offers that will be offered by the banks in the abovementioned promotion period, on top of the said Terms of Use, the User will be bound by the terms and conditions of the said bank/card issuer.

Radium Care will be at liberty to change the price of a product or service at any given time and with no prior notice.

Radium Care Cancellation: Radium Care may have some orders that it cannot take and must be canceled. Radium Care reserves the right to accept or cancel any order at its own will regardless of the reason, without providing any reason to the User. The User agrees and accepts that the same is acceptable and will not claim/form any objection against Radium Care on the same. The circumstances which can cause the cancellation of the User order include, but are not limited to, the inability to get the product(s) or quantities ordered by the User, the inability to get the services, errors or inaccuracy in the pricing information or the issues detected by Radium Care.

Radium Care can also verify or obtain more information on any order prior to accepting it. The User will be contacted by Radium Care in case of a cancellation or any part of the order of the User is canceled or in case of need of further information to accept the order of the User. In the event of cancellation of the order following the charge of the credit/debit cards, Net banking, wallets, UPI/ and any other means of payment, the amount charged would be reversed in the credit/debit card of the User, and Radium Care would not be liable to such cancellation.

The common misspellings of the word radium, which may be entered by the user, are radium - Raduim, radiun, radim, radeum, radyum, radum, radaiom.

Any items/services and information found on the Platforms amounts to an invitation to treat. Your order of purchase is an offer that must be subject to the terms and limitations provided in this User Agreement. We have a right to accept your offer in part or to refuse it. Once the ordered goods or products are shipped, then we will regard your order as accepted. It may happen that you will not receive some of the items immediately after you have placed an order. In case of such a scenario, we will treat all the portions of the order that has been shipped as accepted and the rest will be left to be accepted or rejected. Radium Care will not in any sense accept your offer until the goods you have ordered have been actually shipped. We will contact you either through phone or email as soon as possible to make sure that we have received your order in case you have given us your contact details. We will also make follow-ups to you in case of the need so that we are sure that the order has been dispatched and therefore accepted.

DELIVERY

Between 5-7 working days, delivery is the norm starting on the day of order placement. Order details page will indicate the approximate time frame of shipping and delivery of the product at the time of order placement. Given that the estimated time of delivery can be considered just estimates, there might be some unforeseen delays that we can only deal with. Delivery can be divided into numerous deliveries in case of an order that contains several products.

You also concur that Radium Care will not be liable to compensate any loss or damage ( direct or indirect ) related to such cancellation of the order or delay in delivery. The User is aware that Radium Care relies on the services of third-party delivery companies and will not be obliged to compensate any damages incurred because of the actions, negligence, or lateness of the delivery agent.

QUANTITY RESTRICTIONS

The number of products that a particular person, household or order can purchase is subject to the sole discretion of us, which we reserve the right to limit the amount. These limitations may apply to the same credit/debit card, the same account, and orders with the same billing and /or delivery address. In case of the implementation of such limitations, we would inform the client. Also, we are not bound, in our absolute determination, to prohibit sales of anybody.

The users must never resell any products of Radium Care unlicensed on any online or offline platform. Any such action of any User will grant Radium Care the discretionary right to cancel their Account on top of taking legal action, either civil or criminal, which exists within the bounds of law or equity.

PRODUCT AND PRICING INFORMATION

The advertisements and packaging contain the product and pricing information, which is also provided by the sales representative.

Even after we have tried our best to give accurate product and price information, typing or pricing mistakes might occur. We will at our absolute discretion, reject or cancel any orders that have been placed on any product that is listed with a wrong price or any misleading information as a result of a pricing or product information error and this is not applicable to the case where a product is already shipped. Your offer will not be considered accepted unless the product you have ordered has been shipped, and we shall be free to amend the price of the product and contact you to further instruction through email address or through the contact number you provided during the registration period or cancel the order and inform you about the cancellation. Once you order with us through the Internet, your credit or debit card, UPI, wallet, net banking, or any other payment system can be billed. The successful payment will be notified over the phone or email. The payment can be done before the product ordered is dispatched. As a user, it is your responsibility to ensure that a coupon code, promotional offer, or a discount is authentic before using it.

USE OF THE PLATFORMS

Your Account

To create a new User on the Platforms, Radium Care can gather some personally identifiable data, such as your first name and last name, as well as contact information, such as your email address, phone number, billing/shipping address, and other contact information, demographic data, etc. Registering on the Platforms is considered that the User has given an express consent to such data collection and processing to use the Platforms. It is possible to create and maintain a single user account (also referred to as an Account). You will accept accountability to all the activities that occur on your account, and you will also be responsible for ensuring that your password and account information remains confidential and that no one accesses your computer. CUSTOMER SOLICITATION

Through the use of the Platforms or an order or any information you are also communicating with Radium Care electronically and you consent to periodically and at such times as and when it is necessary to be sent by Radium Care communications (including transaction, promotional, and/or commercial messages). We can communicate with you through email, SMS, phone call, or even post on the Platforms or any other form of communication.We and our suppliers and licensors specifically preserve all intellectual property rights in all text, programs, products, processes, technology, content, and other materials, which are shown in this Platform.

No license of any intellectual property of us or of any third party is granted and access to this platform does not and will not be considered to grant any license. We reserve the right to this Platform, with or without copyright, or we have a license to do so. You shall not edit, transfer or re-blog any material on this Platform.

The trademarks or service mark of Radium Care or licensed to Radium Care is its names and logos and all product and service names, design marks and slogans. All other marks belong to their respective companies and you will not at any time use or exploit the same in any way. You are not provided with any trademark or service mark license with respect to materials on this Platform.

A license to any name, logo, or mark that is displayed on the Platform is not granted as a result of being permitted to access this Platform. Any mention of third party name, mark, product, or service on this Platform, and any hypertext connection to third party Platform or information are solely to your convenience, and do not in any way mean our approval, sponsorship or recommendation of the third party, information, product or service.

The Content, which consists of all materials such as images, text, illustrations, designs, icons, photographs, programs, and music clips or downloads, video clips, and written and other materials all belonging to this Platform is not supposed to be used for any commercial purpose. The downloading or copying of the software does not give you any ownership, rights and or interests in the contents or the software you have downloaded. With the exception of the aforementioned, you are not authorized to reproduce, publish, transmit, distribute, display, edit, or otherwise utilize any of the Content, the Platform or any related software and to undertake any type of full or partial business activity with any of such materials.

All Content included on this Platform, its compilation (that is, the gathering, arranging and assembling all the Content) is the property of Radium Care and is also under the protection of the Indian and international copyright laws. The software and Content contained in this Platform can only be utilized as a shopping tool. The Use of Content on this Platform is strictly prohibited to reproduce, modify, distribute, transmit, republicate, display, or perform any other act in relation to the Content on this Platform.

OWNERSHIP OF RIGHTS

Unless Radium Care expressly and in writing permits you to do so, you shall not utilize this Platform or its contents in any manner beyond your own personal and non-commercial use. This involves duplication, sharing, storing and replication of them wholly or part by part. Any information displayed, transmitted or stored through the Platform is shielded against infringement and various other legal prohibitions of the intellectual property. Copyrights and other intellectual property with regards to some of the materials on the Platform can be held by third parties. The design, updating and maintenance of this site is done by Radium Care or their licensors. The Platform contents cannot be changed, released, transported, sold, reproduced, and used in any other form to obtain commercial profit. You should also not disseminate, re-distribute, perform, display or prepare any of the contents in a derivative form.

USAGE RESTRICTIONS

The Platform you shall not make use of in the following ways:

posting any material, which is unlawful, intimidating, defamatory, threatening, grossly harmful, vulgar, obscene, blasphemous, defamatory, pornographic, paedophilic, an invasion of the privacy of another user, hateful, or offensive to a race or ethnic group, disparaging, or in any other way involving or promoting money laundering or gambling;

posting content that prompts a response that is unlawful, subjects a person to civil disobedience, or violates any other law, regulation, or rule of conducts;

hacking into other computer networks unauthorized;

Ignoring the use or enjoyment of any other person or interfering with networks of the Platform;

copying, distributing, or storing electronically a copyright-protected work without the permission of its owner;

You must never host, display, upload, modify, publish, transmit, update or share any information on the Platform that belongs to another person and which you do not have permission to access;

infringes any copyright, patent, trademark, or other right to intellectual property;

distracts or deceives or otherwise deludes the recipient on the origin of these messages or transmits any content that is expressly offensive or ominous;

Impersonate another, or injure minors in any degree;

carries with it software viruses or any other computer code, files or programs that are meant to disrupt, destroy or cripple the functionality of any computer resource, the Platform included;

endangers the unity, integrity, defense, security, or sovereignty of India; endangers cordial relations with other nations; disrupts the peace of the population; provokes the perpetration of every crime punishable by law; hinders the investigation of a crime; is a slander to another country.

You are also prohibited from:

damaging the security or integrity of the Platform, or an effort to damage it;

Posting on or using the Platform any information (such as job postings, messages and hyperlinks) that is disruptive or competitive to the products/services that we provide;

Any deliberate filing upon the Platform of any incomplete, false, or inaccurate information;

sending any unwanted messages to other users of the Platform;

navigating or searching with any kind of engine, program, tool, agent, or other mechanism (including robots, spiders, avatars, or intelligent agents) by the use of the Platform;

Trying to formulate, decompose, disassemble, or reverse engineer any component of the Platform;

Any copying or duplication of any of the material on the Platform or other information provided on the Platform; and

The contents of the Platform cannot be framed, hotlinked, or deeplinked.

DISCLAIMERS AND LIMITATION OF LIABILITY

The Platform, all content, products, and services on the Platform, or those received by a Web site to which the Platform is linked (a linked site) are available to you without guarantees or warranty. Radium Care does not give any express and implied warranty (a warranty of merchantability and fitness to a specific purpose), title, non-infringement, security and accuracy, to any content, goods or services on this Platform.

INDEMNITY

You also accept that, under any claim or demand, including reasonable attorneys fees, Radium Care (and its officers, directors, agents, subsidiaries, joint ventures, and employees) be defended and held harmless by you upon breach of any law or the rights of a third party, breach of the law or other violation of these Terms of Use, or a combination of both.

TERMINATION

These Terms of Use are in force until and including terminated by either of you or Radium Care. You can cancel these Terms of Use at any other time and in this case you should stop using the Platform further. Radium Care is at liberty to cancel these Terms of Use whenever they wish, and may henceforth cancel such immediately, and in this case, deprive you of access to the Platform, Such termination shall be without any liability to Radium Care. Any download or other receipt of any content on this Platform, along with all copies of such content, regardless of whether it is produced in compliance with the Terms of Use or not, shall be immediately destroyed at the time any of the Terms of Use are terminated by you or Radium Care. Any termination of these Terms of Use shall not annul any right of Radium Care to any comments. Any such termination of the Terms of Use will not affect any liability that may have accrued as a result of the Terms of Use or be a relief that you need not pay for the goods that you have already purchased on the Platform.

GOVERNING LAW

The Terms of Use shall be interpreted in connection with the corresponding laws of India. The Courts at Mumbai shall be vested with the exclusive jurisdiction in any proceeding that occurs in respect of these Terms of Use.

MISCELLANEOUS PROVISIONS

You do acknowledge that you and Radium Care never had and do not now have a joint venture, partnership, employment or agency relationship in connection with these Terms of Use or with any use of the Platform. The execution of these Terms of Use by Radium Care is liable to the prevailing laws and legal proceedings, and not anything in these Terms of Use is in derogation of the right of Radium Care to comply with the governmental, judicial, and law enforcing reclamations or requests to your utilization of the Platform or the information supplied to or collected by Radium Care with regards to such utilization.

The rest of the terms of use shall be used as they are regardless of any of the terms being determined as invalid or unenforceable to the extent that the terms are covered by the liabilities rules and the warranty disclaimers mentioned above. Such a case will see the invalid or unenforceable provision be overridden by a new valid and enforceable provision that most closely fits the intent of the original provision.

Such Terms of Use form the whole contract between you and Radium Care in regard to the use of the Platform and replace any preceding or concurrent communication, oral or written between you and Radium Care in regard to the use of the Platform. A copy of these Terms of Use printed or any electronic notice shall in legal or administrative proceedings based on or connected with these Terms of Use shall be admissible to the same extent and under the same limitations as other business documents and records initially prepared and kept in printed form.
